PRIVACY POLICY
Priority of Terms
The terms listed in the Estimate or Work Order items will take priority over the following Terms & Conditions if there is any conflict.
1. Our Promise
At High Efficiency Cooling & Heating Inc., we are committed to honest advice, quality workmanship, and professional service. If unexpected conditions are discovered during the installation, we will explain the situation, discuss the available options, and obtain your approval before proceeding with any additional work whenever practical.
Our goal is to complete every project safely, professionally, and with your complete satisfaction.
2. Agreement
This document, together with the Estimate or Work Order, represents the agreement between High Efficiency Cooling & Heating Inc. (“High Efficiency”) and the customer. No verbal or outside agreement is binding unless confirmed in writing by High Efficiency.
3. Estimate Validity
Unless otherwise stated, prices on estimates are valid for 7 days from the date of the estimate.
4. Scope of Work
The price includes only the equipment, materials, and services specifically listed in the Estimate or Work Order.
5. Installation & Cleanup
Our technicians will remove old equipment and clean up debris generated during installation, unless otherwise specified.
6. Payment Terms
- A deposit, as specified in the estimate or cover email, is required before equipment, parts, or materials are ordered or work is scheduled.
- The remaining balance is due upon installation, delivery, or completion of the work, as applicable, unless otherwise agreed in writing.
- Credit card payments are subject to a 3% processing fee.
- Overdue balances are subject to a service charge of 3% per month from the date of default.
7. Cancellation
This agreement is subject to applicable consumer protection laws, including the Ontario Consumer Protection Act, 2002. Nothing in this agreement limits or overrides any cancellation rights the customer may have under applicable law.
Subject to those rights:
- Deposits are non-refundable once equipment, parts, or materials have been ordered, or project scheduling has been confirmed.
- If the order is cancelled after equipment, parts, or materials are ordered, the customer is responsible for non-returnable items and any applicable restocking or administrative charges.
- If work has started, the customer is responsible for completed work and materials supplied.
8. New Equipment Warranty
Unless otherwise specified in this estimate or work order:
- Residential Furnace: Manufacturer’s parts warranty (typically 10 years), lifetime heat exchanger warranty (where applicable), and 1-year labour warranty.
- Residential Air Conditioner/Heat Pump: Manufacturer’s parts warranty (typically 10 years), compressor warranty (where applicable), and 1-year labour warranty.
- Condo HVAC Equipment (including Fan Coil Units, Water Source Heat Pumps, PTACs, Chassis Units, Magic-Pak Units, and similar equipment): Covered by the applicable manufacturer’s parts warranty (typically 1 year) and 1-year labour warranty from the installation date.
- Construction-project equipment: Covered by applicable manufacturer warranty and 1-year labour warranty from the installation date, unless otherwise specified.
- Eligible Carrier equipment may qualify for Carrier’s 1-Year Satisfaction Guarantee where available.
Manufacturer warranty coverage, terms, and registration requirements vary by equipment brand and model.
9. Warranty Coverage
Unless otherwise stated in writing, all parts and labour warranties apply only to the original purchaser at the original installation address and are not transferable.
This warranty gives customers specific rights. Customers may also have other rights under applicable provincial or manufacturer warranty requirements. Nothing in these Terms & Conditions limits any rights provided under applicable consumer protection laws.
10. Accessory Warranty
Unless otherwise specified:
- Furnace and A/C accessories, including condensate pumps and thermostats: 1-year parts and labour warranty.
- Humidifiers and air cleaners: 5-year parts warranty where applicable under manufacturer terms, and 1-year labour warranty.
- Boiler accessories, including circulation pumps, water regulators, low water cut-off devices, and expansion tanks: 1-year parts and labour warranty.
11. Repair Warranty
Repaired or replaced parts are covered according to the manufacturer’s warranty. Labour related to the same repaired or replaced part is covered for 90 days. Only parts supplied by High Efficiency are covered. If future repairs are required due to different defective parts, those repairs will be charged separately.
12. Refrigerant
Refrigerant itself is not covered under warranty. A 1-year no-leak labour warranty applies, covering labour related to verified refrigerant leaks only. Any refrigerant required to recharge the system may be charged unless otherwise specified.
13. Extended Labour Warranty
Where an extended labour warranty beyond 1 year is included, annual professional maintenance is required to keep the extended labour warranty in effect. Failure to properly maintain the equipment may affect warranty coverage.
14. Warranty Conditions
Warranty coverage does not apply to failures resulting from:
- Accident, abuse, misuse, or improper operation.
- Operation during construction or renovation.
- Lack of reasonable or proper maintenance.
- Unauthorized repairs, alterations, or service by another party.
Manufacturer warranties are administered according to the manufacturer’s policies and approval process. High Efficiency will assist customers with submitting warranty claims whenever applicable.
15. Ownership
Title to all products and goods remains with High Efficiency until all amounts owing under this agreement have been paid in full.
16. Standard Installation Conditions
For new-house A/C installation, the price includes up to 25 feet of line set and power line unless otherwise specified. Any additional length will be charged separately.
17. Site Conditions & Additional Work
Pricing is based on visible site conditions at the time of estimate. Hidden conditions or concealed spaces, including walls, attics, chimneys, and similar areas, may reveal installation difficulties beyond what could reasonably be seen during quoting. Additional labour and materials required due to these conditions will be charged separately and, where practical, discussed with the customer before proceeding.
18. Exclusions
Unless specifically included in writing, the price does not include:
- Electrical service upgrades or permits.
- Painting, drywall repair, or surface finishing.
- Corrections to defective chimney or flue systems.
- Structural modifications.
- Other work not specifically listed in the scope.
19. Access & Safety
The customer is responsible for providing safe and clear access to the work area. Additional charges or delays may apply if access is restricted, unsafe, or if existing site conditions make the work more difficult than originally expected.
20. Limitation of Liability
High Efficiency is not responsible for damage resulting from pre-existing site conditions, concealed defects, or circumstances beyond our reasonable control. Minor cosmetic effects resulting from removal of existing equipment, including dust, soot, or marks on surrounding finishes, may occur despite reasonable care.
21. Acceptance
For estimates, acceptance of the estimate or payment of the required deposit confirms acceptance of these Terms & Conditions.
For work orders, commencement of work or customer authorization confirms acceptance of these Terms & Conditions.
